Obama's Immigration Decree: The Ugly Details

Obama’s Dream Act gambit is a bald-faced political ploy to make up for his immigration enforcement sins

Obama’s imperial Dream Act decree is fraught with danger and rife with loopholes, not to mention that it deals with a murky world where facts cannot be established and documentation fabrication is rife. This is a perfect example of why our government was not designed to be run by dictatorial fiat. Open hearings where experts for all sides can testify is how policies like this must be enacted in a democratic republic.

Mickey Kaus provides damning details on Obama’s immigration diktat:
It also would give work permits to those who snuck across the border by themselves as teenagers. “Through no fault of their own” is a talking point for DREAM proselytizers, not an actual legal requirement. (Kausfiles – Maddening Details)
He goes on to explain that “Continuous residence” doesn’t mean what we think it does. Even those who returned home (wait, I thought this place was their home?) and then came back are still eligible. Also, criminals are not excluded so long as their jail stay was less than 90 days.

Please go read Micky Kaus’s excellent blog post on this. He is a superb blogger who marshals his facts carefully, and most importantly, he links everything so you can go investigate it yourself. Follow the links in his post and you’ll understand why the President’s actions are so damnable.

The Obama Administration has done a pretty good job on immigration

I want to give President Obama credit. About 1/3 of jobs filled in the US now use e-verify, and under the Obama administration, government immigration audits of companies has increased. I applaud this approach. I don’t like workplace raids, with armed federales storming workplaces like this is some third-world dictatorship.

E-Verify cracks down on identity theft and reuse of dead people’s social security numbers, which is how illegal immigrants get “legal” documentation. The immigration audits do the same kind of checks on a company’s personnel data. When an auditor finds a discrepancy, he asks to interview the employee in question. If the employee is using bogus data, he takes a powder. If it is a mistake, the employee comes forward and the situation is resolved.

This two-pronged approach is the intelligent and efficient way to go about it. Add in some smart border control and we would have the problem of illegal immigration contained. I’m not so adamant on The Fence. An 11 foot ladder overcomes a 10 foot fence. What I am for is to stop spying on Americans with all those drones and instead press them into service on the border. Add in sensors on the ground, command and control networks, National Guard augmentation, and you have something much more effective than a fence.

Once people know that they cannot get a job or social services using bogus credentials, they will stop coming here illegally. With the border secured and our immigration situation under control, we can then allow in people who want to work or visit relatives. Most importantly, they can enter and travel freely with dignity, as befits this land of the free and home of the brave.

When Reagan granted a similar amnesty, the second prong, securing the border, was never funded by Congress.

As you so aptly pointed out, the problem is solvable. However, neither Party has had the will to solve this most critical problem. The demographics and, therefore, our culture are changing rapidly and as a nation we will pay a terrible price.

I don't like the idea of RAIDS either, it smacks of what our country's not about.
I'm not sure closing the border is as easy as it sounds here, but I like to think so!
And, not allowing the 'social service' of hospitalization is going to be tough...
Going to Klaus's blog now..thanks.

Yet, immigration is way down and Obama is deporting far more than Bush ever did, go figure.

As long as Big Agro wants the labor, the GOP will make sure it's there for them. All this "enforcement" and "border control" is bullshit.

If there is no work, the majority will not come. Sometimes the answer is rather simple. Shut the border, and those left will likely go home provided we do not support them.

Trekkie4Ever said...

Shut the borders, no more hand-outs, absolutely no more free anything for illegals period.

I agree, use the drones to watch our borders. Not a bad idea at all. That would really deter most of them from crossing.

And I believe anyone hiring illegals should pay very stiff penalties or jail time.

We need to have more people like Sheriff Arpaio. He's awesome.

AOW: "When Reagan granted a similar amnesty,..."

Just to be accurate, Reagan didn't 'grant' an amnesty. Reagan signed into law a bill, The Simpson/Mazzoli Immigration Reform and Control Act of 1986, approved by both House and Senate. It's Obama who's attempting to 'grant' an amnesty by executive fiat, usurping the roll of Congress.

Always On Watch said...

Viburnum,
You're right.

I stand corrected.

SF: TURN ON THE NEWS if you're not already watching it.

They lost control on the east, fire is burning into Mountain Shadows and Peregrine and according to the scanner they are losing structures.

Finntann said...

Looks like the fire jumped Rampart Range Rd and ran down into Queen's Canyon and up the other side. Now burning down towards Flying W Ranch Road, Centennial,North Woodman.

According to the radio traffic they are falling back to 30th Street at Garden of the Gods.

Guy on the radio said "I'm Driving down Powers Blvd and it looks like the Zombie Apocalypse".

There are spot fires throughout the area.

The city is definitely losing structures.

It's Obama who's attempting to 'grant' an amnesty by executive fiat ...

-----------
The President shall ... have Power to Grant Reprieves and Pardons for Offenses against the United States, except in Cases of Impeachment.

So it's hardly by fiat.

Finntann said...

Case by case Ducky.

You want the President pardoning people accused of Murder before trial?

By your logic he can invalidate any law passed by congress simply by invalidating the penalties.

viburnum said...

As long as we're quoting the Constitution, try this one on for size. "he shall take Care that the Laws be faithfully executed" ( Article 2 Section 3 )

viburnum said...

After they've been faithfully executed, that is to say, adjudicated in a court of law, his power to grant reprieve of sentence, or pardon comes into effect. Not before.

FreeThinke said...

The law has been EXECUTED all right.

Face it. It's DEAD as a DOORNAIL.

Obama sees himself as a latter day Louie Katz

Fortunately there is one irrefutable and unbiased expert in Constitutional law to bear witness to the impropriety of Obama's action here.

"With respect to the notion that I can just suspend deportations (of immigrants brought here illegally as children) through executive order, that's just not the case, because there are laws on the books that Congress has passed."

Thank God the wind is blowing away from your place, but we are inundated with smoke here. Visibility less than half a mile, its raining ash.

Heading home from work I saw flames at the top of the ridge behind GoG...

This is freaking scary...

Finntann said...

All hell is breaking loose on the west side.

Over 20 structures lost along Flying W Ranch Road according to the radio chatter.

USAF Academy is prepping for evacuation.

The whole west side is going up west of Centennial.

CSPFD has pulled back to 30th and Centennial.

Smoke bad at your house?

Pictures of the Springs show a black and orange sky at least as far east as I-25.

Let me know if you need anything.

Silverfiddle said...

I don't need anything, from what I hear, you guys need gas.

I just pray it rains like hell. They're already mentioning spot fires in town due to blowing ash. The only good I see is it chased the deer out of my neighborhood. Damned things ate the tops of all the wife's flowers in the front yard.

Silverfiddle said...

Finn: Go to my FB page. I've got pics posted of how it looks from town.

I heard it looked like the scene from Bambi down there with all the wildlife running through the streets.

This is some serious shit.

I used to live up there.

Reporter just said it took an hour to get down Rockrimmon to get out . Evac up to the south end of the Academy.

South bound I 25 shut down in that area

I hope you guys will be all right out there in The Fire Belt. It sounds really serious. I'm sorry you have to face anything like that.

Maybe Obama will deign fly out in Air Force One and command the flames to stop.

His motives would be cynical, of course, but who cares if he achieves good results, right?

Sorry! It's no time to be flippant or cynical. I realize it's a terrible thing.

May God protect you and your families and friends!

Good luck, there. At this point, much of it will be luck. I have been through this twice the last decade in San Diego. Horrible.

The wife is worried the fire will jump I25, and she's got a point. Lots of green between here and there, but I'm not worried.

The kids are gone to grandma and grandpas, so her and the guitars are all that's worth saving...

I don't know the Colorado area.

Whatever is going on sounds awful!

Silverfiddle said...

AOW: It's just nature reasserting itself. It happens every now and then out here.

This area has always been dry, and evidence of forest fires go back millennia, but the lefty Gaia worshipers are screaming that it's all because of global warming and that we haven't turned over trillions to the crooks and rapists at the UN so they can implement their plan to turn the Earth's thermostat down...

Alligator said...

Hope you guys weather this fire okay.

I've been involved with some archaeological projects. There is physical evidence of massive and periodic droughts, forest and prairie fires going back thousands of years. Of course, now some Lefties are moving away from "industrialization causes global warming" to "humans practicing agriculture thousands of years of go started climate change."

No matter what evidence emerges, the line of human caused climate change will evolve to counteract the evidence. Shoot, even now the theory is emerging that too many dinosaurs producing flatulence caused climate change in the Jurassic.

The goal is: vote Democrat - their policies can prevent what nature has been doing for millions of years.

Silverfiddle said...

Thanks Alligator.

They've dug up tree sloths the size of cars and mastodons near Steamboat springs that are thousands (tens of thousands?) of years old.

I doubt the oil companies and people driving SUVs killed them...

It is pretty sad watching my town burn. So much loss...

Always On Watch said...

I just did a bit of online research about this wildfire.

I don't know about Colorado, but I do know about Pasadena, California, and the Altadena Wildfires of 1993. My in-laws' house was burned to the ground. The fire was so hot that all the jewelry in the "fire proof" safe melted down and had to be scraped -- gold and precious stones.

Fortunately, all in the house got our about 5 minutes before the house EXPLODED. I got so hot that it combusted within the cinder block "fire walls."

FEMA dragged on and on and on. Eventually, my mother-in-law, age 73, sold just the land for a pittance.

One cause of the fire was environmentalism. EPA regs forbade trimming the brush in the canyons.

You get the picture, I'm sure.

Silverfiddle said...

AOW: It's a constant fight out here. The Enviros got an EPA injunction on dropping slurry near streams because it killed some fish in California.

The enviro-nuts also block all efforts to do preventive cutting and brush clearing, making America's western forests tinderboxes just waiting to go up.

Most of these Gaia worshipers do little more than drive by these mountain forests on their way from one trendy place to the next.

Hunters, campers and fishermen are the real nature lovers. We want it protected and preserved.

Finntann said...

There was a guy 'fire expert' on the news talking about the area the fires first burned into, a community called Mountain Shadows.

He said that the homeowners association had rules that prevented homeowners from cutting down the Gambel Oak, thus preventing them from creating any "defensible space".

No idea if it's true or not, but it illustrates your point about preventing brush clearing.

Thanks Shaw, fortunately for us, we are out of the way, but there are many who no longer have homes...

I understand the anxiety and fear that goes with this situation.

My daughter lives in SoCal and has had to endure wild fires. I was out there one year when they were fierce.

I hope this is over soon.

I've said it before - while I don't necessarily believe that just because you're here, you should be inferred the rights of citizenship, that's a landmine that no politician is going to have the guts to step on.

So, grandfather in everyone who is here and be done with it. End of argument.

BUT - before you do so, be sure and shut down the borders tight. And we absolutely don't need boondoggle fences for this. We already have some of the world's most sophisticated and capable military resources on our payroll - let's put those systems, tools, and manpower to use defending our own country for a change!
